MISSION STATEMENT

We are a department who strives to complement the educational and service goals of New Mexico Tech by promoting personal growth and social awareness while enhancing student learning.  Joining with students, we strive to create safe and supportive opportunities for the development of interpersonal and leadership skills in a residential environment.
 

 

RESIDENT'S RIGHTS & COURTESIES

Every successful residence hall depends on the residents understanding different lifestyles and respecting the rights of others listed below are rights and courtesies to help you, your roommate, and other hall residents adjust to the community living environment.

  • Residents have the right to study and sleep without interference, noise or distractions.
  • Residents have the right to personal privacy.
  • Residents have the right to live in a clean environment.
  • Residents have the right to have guests, but must take responsibility for their guest’s behavior.
  • Residents have the right to express concerns to the Residential Life staff.
  • Residents must respect their roommate’s belongings.
  • Residents have the right to their own unique interests and values.
  • Residents have the right to be free from intimidation and physical or emotional harm.
  • Residents have the right to be treated as they want to be treated.
     

 

RESIDENT ASSISTANTS

All the residence halls have RAs who are upper-class students. RAs at Tech play many different roles:

  • peer counselors
  • resource people
  • authority figures
  • academic advisors
  • educators
  • programmers
  • administrators

RAs spend a significant amount of time getting to know students on an individual basis as well as working to bring residents together to create a positive floor and hall community. Your RA has not only experienced the day-to-day problems and anxieties that you may encounter as a student, but has been specially trained to help you handle them. RAs are there to help you adapt to your living and academic environment. They will guide you through the many issues that confront today's college student, such as academic difficulties, social life, and personal problems.

RAs also lead various activities that allow you an opportunity to meet and interact with other students at Tech. You will have many opportunities to take part in a variety of activities that will help you grow socially, academically and culturally. The RAs are committed to helping you to achieve the best college experience by keeping you connected to all the opportunities Tech and the surrounding community have to offer.

GENERAL INFORMATION
             
          Academic Suspension Policy
                     
        Residential Life will hold Summer and Fall room reservations if a request and academic appeal is filed by June 1.

            If you do not file an academic appeal with the Registrar’s office by June 1st, your room for Summer and Fall will be cancelled.
          
            If the appeal is declined, the room is immediately cancelled and the Residential Life Office cancellation policy is in effect.

        Spring room reservations will be cancelled as the suspension/probation list is created and released from the Registrar’s Office.        

        The student has until Registration Day for the Spring term to file an appeal.
           
            If this appeal is not filed, the student will be required to vacate and be subject to the Residential Life Office cancellation policy.


            
Cancellation Policy
              
      
      Board Plan Cancellation Policy:

               Board Plan changes (from one plan type to another) may only be made during the first week of the semester. Changes cease on the Friday after Registration each semester.
      
               Students who are not required to be on a board plan may cancel their board plan through the third week of the semester, and will only be charged for the number of weeks he/she was on the board plan (partial weeks will be rounded up to the next full week) and refunded the rest of the board fee.
       
              After the third week of the semester, the student will receive no refund on the remaining portion of the board plan.


 Residence Hall Cancellation Policy:

               The $200 Housing Deposit you paid upon enrollment serves as both a reservation fee and contractual guarantee.
   
               Residence Hall Term refers to those halls that close at the end of every break, Driscoll, Presidents, West, South and Baca Halls.
   
               Apartment Term refers to those halls or apartments that are open year round: Altamirano Hall, Guest House, Desert Willow, and Mountain Springs Apartments.

 

 Residence Hall Terms
               1. The Residence Hall Liscense Agreement is for the academic year (August through May).  The Residence Hall Term begins on the first day that the halls are open for occupancy.  See the Term Schedule for these dates, as they change every semester.
             2. The Cancellation Deadlines are June 1st for Fall and December 1st for Spring.  Incoming students who cancel their agreement before these dates will receive no penalty.
               3. Returning students who cancel their agreement for the upcoming academic year prior to June 1st without penalty.  Cancelations after June 1st will incur a $400 penalty.  Room cancellations made after the begining of the Apartment/Residence hall term will receive no refund on their room rent.  Cancellations for spring semester will be a $400 penalty as this agreement is for the an academic year (fall and spring semesters.) 
    
             Students with extenuating circumstances for canceling the residence hall agreement must submit in writing to the Residential Life Office to request a waiver of contract break fee and/or waiver of refund schedule.

Apartment Terms

ID Cards
           
         All doors in student housing are equipped with a card access locks. These locks read the information stored on the magnetic strip of your ID card. There are four possible sequences of lights that will occur after you insert and remove your card from a reader:    


             Green light: your card has been accepted and the door is now unlocked.
         
               Double green light: the door is unlocked until you key the door twice. This feature is available only in the     personal rooms of the student apartments and other select locations.
      
               Green light and flashing Red: The batteries in the lock are running low and need to be changed. Please contact your RA so they can submit a work order.

               Red and Green light: Your card is expired, you need to have it updated as the door will not unlock.

                Red light: You don’t have permission to access this room.


Expiration dates:


             Residence hall cards will be active from 9am August 20, 2010 to 5pm December 17, 2010 and from 9am January 15, 2011 to 5pm on May 16, 2011.
      
               Apartment cards will be active from 6pm on August 18, 2010 to 5pm December 17, 2010 and from 9am January 13, 2011 to May 16, 2011.  Residents who will be staying over the break will need to have the expiration dates extended by coming to the Residential Life Office

             If you are a graduating senior, and live in a residence hall, your card will stop working at these times as well. Please come to the Residential Life Office to have your card extended to 5pm on May 17, 2011.

        
Lost Card

             If you loose your ID/key you need to do two things. Come to the Residential Life office immediately to get a temporary key. This key will only work for 24 hours. During this time you need to go to the Registrar’s Office and purchase a new ID and have it encoded in the Residential Life Office as soon as possible. As soon as a new key is used to access a door, the old key will no longer work. Return to Top


Dining Room

           All students on a meal plan will be required to use their Student ID to enter the dining room. Students entering the dining room will give their ID to the Chartwells staff to verify the ID matches the person entering, they will then swipe your card to verify you are on an active meal plan. If you do not have your ID, you will be required to get it before being allowed in the dining room.  You may swipe your ID card to treat guests, friends, and family to meals in the dining room, limited to eight meals per student per meal.

            Students are asked to be conscientious that wasting food, removing dishes from the dining room, and vandalizing dining room property result in increased cost for everyone.  

               Behavior that compromises the sanitation of the food service area and dining room will be addressed by food service management and/or Residential Life.



Emergencies
             
         In any emergency, contact one of the Resident Assistants. If they are unavailable, contact the:

         Residential Life Office -5900 (8:00am – 5:00pm, Monday – Friday)
         Campus Police -5434 (24 hours a day, 7 days a week)


 Locked Out Of Your Room
              
         First ask your RA to let you in your room. If your RA is unavailable: 1) call the Residential Life Office, (between 8am - 5pm, Mon.- Fri.); 2) if Res. Life is not open, call Campus Police, x5434 and ask to have the on-call RA paged. Allow up 30 minutes for the RA on call to be located and informed of the situation. You may be subject to a $5 lockout fee.
            

 Long Distance Calling
            
         The phones provided in your room provide you with local phone service. If you wish to make long distance calls from your room you will be required to use a calling card or obtain a TAC number from the ISD department on campus. If for any reason, a call is made or received which results in long distance charges being assessed to your room, these charges will be charged to your student account along with a $5.00 fee.                


Mail
                     
         Daily mail will be placed in your post office box. The Post Office is located in the Student Union Building. If you receive a package, you will find a notice in your box. You must pick up all packages at the Post Office. All personal packages must be sent to your personal box and not to the Residential Life Office. Your address should appear as follows:

Maintenance and Work Orders
                  
         University shall perform all maintenance to the rooms/apartments; however, the Resident will be charged for maintenance due to his/her negligence except that which is normal or routine and in conjunction therewith.  The University shall have the right through its agents and employees to enter the room/apartment for the purpose of examining, inspecting and maintaining same. Resident is responsible to maintain the property in a clean and sanitary fashion.
         All maintenance work orders for your room/apartment, etc. should be directed to your RA or the Residential Life Office. Allow sufficient time for the request to be completed. If the request is not repaired by the end of the following day, put in a second request. Communication with the Residential Life staff is important to determine the status of all work orders. If maintenance personal respond to a work order and is turned away, a $50 refusal of service fee may be charged to the student’s account.
         For emergency after hours and weekend work orders, inform your RA or call campus police. Facilities Management will respond to emergencies (power outages, leaking water, etc.)



Oil Changes
          
         We realize that some residents prefer to maintain their own vehicles including changing your oil on a regular basis.  Facilities Management has agreed to allow you to use space by their garage in order for you to change your oil.  This will prevent large oil messes from occurring in the parking lots and offers you a location to discard your old oil.   Please do not use the parking lots for changing your oil.  Please see the attached map for the location to change your oil.  You will be responsible for providing your own ramps, oil pan, etc.  Please contact your RA or the Residential Life Office if you have questions.
        

Parking
         
         There are no parking fees or designated areas to park on campus, however, you are required to register your vehicle with the Residential Life Office. Cars/trucks illegally parked in handicapped spaces, fire lanes, or other designated “No Parking” spaces are subject to being ticketed and/or towed at the owner’s personal expense.   Vehicle owners are responsible for cleaning up any mess left in the parking lot from their vehicle (mud, oil, litter, etc).




 COMMUNITY STANDARDS
          

 Advertising
              
         Any advertising must be on a bulletin board or a student’s door. Advertisements are not permitted on walls, windows, door windows, etc. Advertising of events involving the sale of alcohol is not permitted. Please submit all advertisements to the Residential Life Office for approval.

        

 Alcohol
                  
         The following guidelines and rules shall apply to residents and their guests in the residence halls/apartments and their environments:

             The consumption and storage of alcohol in the residence halls may only occur if all of the following circumstances exist:
                  1. Both residents occupying the room are 21.
                 2. Everyone in the room is 21.
                     3. The door and blinds to the room are closed.
                 4. The residents and/or guest(s) are not causing a disturbance to the rest of the facility.
                 5. Non-resident guests are also responsible for following this policy and will be subject to disciplinary action.

             If you are found to be violating the alcohol policy of New Mexico Tech Residential Life the following can occur:
                 1. All alcohol (open or unopened) will be destroyed
                 2. Campus police will be called to cite all individuals in the room
                 3. Full incident report filed with subsequence disciplinary actions and sanctions as covered previously.
       
   
              New Mexico Tech students who are 21 years of age and older may consume alcohol in private residence hall/apartment rooms as long as they do so in moderation and in a way that does not cause a disturbance or significant concern for other residents or the Resident Assistant. Kegs (party kegs, pony kegs, party balls, etc.) are expressly prohibited. All students attending an activity where alcohol beverages are served, consumed, or present must maintain on their person a clear means of picture identification as appropriate proof of age.      
 
               Individual room residents are charged with the responsibility for the conduct of their guests and must act to ensure that the relevant New Mexico laws and New Mexico Tech rules are observed by their guests.  However, if off-campus guests are in violation of Residential Life policies, they may be excluded from visiting the halls.
      
                 Resident Assistants are bound by the same rules and regulations as other students.
       
                 A student objecting to the consumption of alcohol by his/her roommate will be given priority in seeking acceptable on-campus housing.

               The selling, direct or indirect, of alcoholic beverages in the residence halls is prohibited.

             The possession/collection of empty alcohol containers is prohibited.
      
                Manufacturing or producing alcohol in the Residence Halls or Apartments is not permitted.
       
                 Students and guests must abide by State laws as well as New Mexico Tech campus rules and regulations regarding the purchase, possession, transportation and consumption of controlled alcohol-containing beverages.
       
               Students and guests who refuse to recognize and obey the authority of the Resident Assistants or Campus Police Officers risk arrest and/or prosecution under the General Campus rules as delineated in Student Handbook.


 Reminder About The Open Container Law
            
               Alcohol cannot be consumed or carried in any open containers on any street, sidewalk, alley, automobile, or other public place within the State of New Mexico. The law applies to all areas of campus unless the area is a licensed facility and the required permission has been officially granted.

                 

Bikes, In-Line Skates, Skateboards
             
        Bikes, skateboards, in-line skates, and other wheeled modes of transportation are not permitted in the common areas or balconies of any residence hall/apartment. Designated bike racks are located outside of each residence hall. Cleaning and repair costs to tile floors, carpets, and walls caused by rubber wheels or tires will be charged to the student or students responsible.



Bomb Threats
             
        Bomb threats and/or placement of bombs or intentional facsimiles of such devices in college housing or college property is prohibited. Violation of this policy will result in eviction from the residence halls.



Check-Outs
        
        Residents are required to check out of their rooms by 5:00pm of the last day of finals week. Any student not checked out by that time is subject to being charged an “improper check-out” fee. Any items left in the room at the time of check-out becomes the property of New Mexico Tech and you will be responsible for the cost associated with cleaning, storing, or moving the items.  Abandoned property with a value of less than $100 at the time of purchase will be disposed of immediately after check-out.  Abandoned property with value greater than $100 at the time of purchase will be stored for thirty days.  Storage and disposal fees will be charged the the student's account. You must set up a time with your RA at least 24 hours ahead of the time you wish to check-out of your room.


Damages, Vandalism, and "Corporate Responsibilities"
              
        Personal Living Quarters:
        At the time of check-in, each resident will complete a detailed room condition report documenting any existing damages. Each student will receive a copy of the form at the time of check-in. The check-out portion of the form will be completed when the resident prepares to move out of the room. Any repairs or damages to the room or it’s furnishings beyond normal wear will be assessed to the resident who is responsible or to all residents of the room or apartment if the individual responsible can not be determined.         Common Areas:
        In public or common areas of Residence Halls or Student Apartments (lounges, hallways, kitchens, bathrooms, elevators, and stairwells) the replacement or repair costs for damages are assessed to an individual when responsibility can be determined. However, when individual responsibility cannot be determined for damages, the residents of the floor, wing, entire hall or apartment, are collectively responsible for repair costs. This action of “collective billing” or “corporate responsibility” is taken by the Director of Residential Life. All damages are assessed and forwarded to the Business Office and will be charged to each individual’s account.



 Door Propping
              
        Doors in Driscoll, Presidents’ and West Halls are locked 24 hours a day for your safety and security. Do not prop open the door for any reason. When expecting the arrival of guests, have them call ahead of time and then wait for the arrival. Do not give anyone the exit key to your hall, as you are responsible for the key. If you have come upon on a door that has been propped open, please remove the prop and shut the door.



Drugs
                 
        New Mexico Tech does not condone the possession, use, distribution, or being under the influence of illegal drugs or controlled substances. The misuse of prescription drugs or other legal uncontrolled substances in or around the residence hall/apartment communities will also not be tolerated. Please understand that this standard applies to drugs, controlled substances and/or related paraphernalia. Any individual known to be in violation of this policy is subject to criminal and/or disciplinary action, including eviction, and possible arrest, imprisonment, or fine according to state law.
 

        Students in violation of the Alcohol and Drug community standards, depending on severity and number of infractions, are subject to dismissal from the residence halls. Those students dismissed from the hall on an alcohol or drug policy violation will be given 24-hours to check out of their room.



 Fire Safety
                 
        New Mexico Tech has a commitment to providing students with a safe and comfortable environment in which to live and learn. One aspect of this commitment is a dedication to fire safety.  A list of all prohibited fire danger items are listed in the "Prohibited Items" section of this handbook (below).

        
       Fire Alarms:
        Regardless of the frequency of alarms, participation in evacuation procedures is mandatory. Failure to comply may result in dismissal from the residence halls. Respond to all alarms regardless of whether or not you can see fire or smell smoke. Fire drills will be conducted in all halls at least once per semester. Evacuation procedures are posted in all the halls.
        
        False Fire Alarms:
        False fire alarms are a federal offense and will be dealt with in that manner. Any resident caught tampering with fire safety equipment may be suspended from the college and/or college housing and prosecuted through civil authorities. These alarms are here for your safety. Please leave fire extinguishers in their proper places unless an emergency occurs. Anyone purposely setting off a fire alarm or extinguisher will be fined and will be subject to prosecution by local authorities.



Inappropriate Material
        
        Pornographic or X-rated materials (movies, literature, and videos) are prohibited in public areas. No pornographic pictures are allowed to be displayed on room doors facing the hallways or facing out your windows. Please don’t display inappropriate or objectionable window or door decorations. Final judgment in this regard will be made by the Resident Assistant or the Residential Life Office.            



Gambling
              
        It’s not allowed, no matter the amount.


Guest Policy
             
        Rooms/apartments are to be occupied only by the student(s) for whom they are reserved except in the case of temporary guests. Guests may not reside on campus for more than two nights at a time. The maximum number of overnight guests shall not exceed two per room. New Mexico Tech reserves the right to revoke guest privileges.  Guests should be escorted at all times while in the building.  The rights of the roommate(s) to privacy, safety and access must always be respected. Cohabitation is prohibited in all college residence halls and apartments. Remember that you are responsible for your guest’s behavior and they must abide by all college regulations. Disregard for your roommate’s rights or repeated violation of this policy will lead to disciplinary action, which may include removal from campus.



Hall Furniture

        The common furniture is for all residents in your hall, borrowing or taking furniture is considered a theft and will be dealt with in that way. Please do not remove it from designated areas. If furniture is missing from common areas, the wing, hall or apartment will be charged for replacement.
              


Kitchen Facilities
              
        Driscoll Hall, Guest House, and Graduate Halls have the only community kitchens on campus. The residents in Driscoll will be issued access to the kitchen at the student’s request. The student will assume responsibility for all cleaning of the kitchen. If the kitchen is not kept clean, the privilege will be revoked. The RA’s in the Graduate Hall and Guest House will set up a cleaning schedule to insure regular and proper cleaning of these areas.



Personal Property
              
        New Mexico Tech will make every reasonable effort to protect the personal property of residents, but will not be liable for articles lost, stolen, or damaged by fire, water, heat and/or natural disasters. Students should mark personal items with an individualized descriptor (initials, etc) and consider the purchase of renter’s insurance to cover loss or damage to personal property.
        New Mexico Tech will not be responsible for damages to electrical equipment (computers, microwaves, TV’s, etc.) due to power surges caused by room overloads. Students must provide their own surge protectors.



Pets
              
        No pets are allowed in any of the residence halls or apartments. No exceptions are made to this policy regardless of the pet size or emotional relation. This policy is strictly enforced. Violation of this policy could result in dismissal from the halls or apartments.



Quiet Hours
             
        Specific quiet hours are set to ensure an academic atmosphere. Quiet hours are 10:00pm until 8:00am Sunday through Thursday and midnight until 10:00am Friday and Saturday. Noise that is determined by the Residential Life staff to be excessive and disturbing to the residence hall environment will not be tolerated. Please respect and be courteous of other student’s rights to a quiet environment, “Courtesy Hours” are in effect 24 hours per day. Baca Hall has 24-hour quiet hours.



Right of Privacy
              
        Students are guaranteed the reasonable privacy of their room and belongings. However, under specific guidelines, rooms may be entered and inspected by New Mexico Tech staff members. These guidelines include, but are not limited to: cases of emergency, need for repairs, health and safety inspections, and when probable cause exists to indicate that a violation of college regulation, federal, state or local laws may be taking place in the room. This right is exercised with great discretion.



Room Alterations
             
        Residents/occupants are not allowed to paint, alter or remodel any room or public area in the residence hall without prior approval from the Director of Residential Life. Damages will be assessed to the residents concerned.



Room Changes & Consolidation
            
        New Mexico Tech personnel reserve the right to enter and inspect students’ room for suspected violation of college rules and regulations, to determine the condition of safety, to be sure that health standards are being maintained, and perform maintenance as required. Student rooms will be entered and the students’ privacy protected in accordance with state law. Announcement will be made before periodic inspection. While recommended, it is not necessary for the student to be present at the time of the room inspection or repair of the room. Fire drill checks during fire drills will also warrant entry and inspection. Rooms may be entered for the purpose of determining if all residents have evacuated. Failure to evacuate the building during a fire drill will result in discipline sanctions and possible legal prosecution.

 

Emergency situations which warrant entrance into rooms by New Mexico Tech:


                  Occupant verbally calls for help, or other noise coming from the room that would lead a person to believe the occupants are in danger.
    
                  Occupant is believed to have been missing for two or more days for an unknown reason, and/or is reported missing by roommate or a call of concern.

                Imminent danger threatening residents (fire, bombs, smoke, gas, electricity, lack of heat, too much heat, trespassers, etc.)

                  The room and/or occupant’s belongings are threatened by hazards.
    
                     Conditions in a room are an annoyance to other residents, i.e., radios, phones, alarm clocks, stereos, intrusive odors, loud noises, etc.

    
        If a resident’s room is below a reasonable standard of cleanliness, she/he will be advised that corrective measures should be taken. Failure to make suggested corrections within 48 hours may result in eviction.


Room Entry:
                In case of emergency, or because of a (suspected) dangerous trespasser, or (suspected) violation or policy, staff members will knock and proclaim entry, but need not receive verbal permission before entering. If, in the mind of the staff member in charge, the danger is of sufficient magnitude, and if s/he is reasonably sure that the occupant or college property is in danger or laws are being broken the staff member then may enter the room.

                If an occupant is not present, a staff member will enter with another staff member or resident whenever possible.

                New Mexico Tech reserves the right to:


                  Inspect/search individual rooms in cases where there is reasonable cause to believe the occupant has concealed within the room, property or possessions of which is a violation of college regulations or municipal, state, federal law.

                 Request a search warrant from Socorro Police Department or Socorro County Sheriff’s Department when there is probable cause to believe a violation of municipal or state law has occurred or the occupant has concealed within the room property which is in violation of municipal, state, or federal law.



Room Inspection/Entry
             


Self Harm

            Part of the educational mission of the university is to develop an inclusive learning environment and suggests that students have goals and objectives. In achieving these goals and objectives, it is necessary to refrain from behaviors that interfere with the educational mission. New Mexico Tech is committed to the goal of helping students succeed in college by removing barriers to success and remains fundamentally concerned about the physical and psychological welfare of all its students. Careless conduct, which creates an unnecessary risk of physical harm to self or others, or actions which disrupt the life of the academic and/or residential community, will not tolerated. The Director of Residential Life will decide what type of response will be appropriate for the specific situation after the investigation of facts has occurred.  Students are encouraged to report potentially harmful situations if they are aware of them.        
            


 Sexual Harassment
              
        Sexual harassment is unsolicited attention directed towards a person’s sexuality or sexual identity. Sexual harassment can occur student to student or faculty/staff to student. Grievances involving sexual harassment should be brought to the Affirmative Action Office located in Fitch Hall.



 Smoking
             
        New Mexico Tech has an interest in maintaining a healthy environment for all its residents.  Therefore in accordance with the New Mexico Clean Indoor Air Act, NMSA 1978, § 24-16-1 through 11, the following policy has been established.

         Smoking of tobacco products and use of items such as incense, potpourri, candles, cloves, sage and the like are prohibited in all residence halls/apartments as well as within 25 feet of the buildings and air handling equipment (e.g. swamp coolers).   Examples of areas that are prohibited include your room/apartment, lounges, stairwells, fully/partially enclosed walkways/corridors and elevators.



Solicitation
        
        New Mexico Institute of Mining and Technology does not allow door-to-door solicitation of funds, products, or services in the residence halls. If a resident wants to invite an individual into the residential area to demonstrate and sell various items, permission must be obtained from the Residential Life Office. Fund-raisers sponsored by campus organizations are permitted in the hall lobbies and main lounges, but they must cleared through the Residential Life Office. Any solicitors should be reported to the residence hall staff.

              

Stolen Items
             
        Any item which has been stolen will be confiscated immediately, returned to the proper authorities, and campus police will be notified.  These items include, but are not limited to: street signs, campus signs, or any other item belonging to another New Mexico Tech department.  Please keep the proof of purchase information for any questionable item in your possession.




Violence/Fighting/Threat or Intimidation
         
        Any action of this nature cannot be tolerated within a residence hall community. Any person willingly engaging in such activity will be evicted from the residence halls/apartments of New Mexico Tech. If it is determined that both parties were willing participants, then, both will be evicted. If it can be determined that one party was clearly the aggressor and at fault, then only that party will be evicted from the residence halls.  Students should immediately report acts of threat or intimidation to the Residential Life Office.

   

Weapons
              
        Firearms, fireworks, flares, ammunition, bows/arrows, tools of the martial arts, gunpowder, air soft guns, paintball guns, paintball ammunition, stove fuels, solvents, water balloon launchers, large knives (6”or longer), swords and any other lethal weapons not listed are prohibited in the residence hall rooms. RA’s discretion may be used in determining if other items will be permitted/confiscated. If weapons or explosives of any kind are found in a room, they will be confiscated by local law enforcement. Anyone having any of the above mentioned items in rooms will be subject to immediate removal from the residence halls.



 Residence Hall Specific Standards
                    

                       Items-Not Permitted
                    
               Space heaters, toasters, toaster ovens, candles, halogen lamps, lava lamps, firearms (it is a Federal Offense, 4th degree felony to possess a firearm on any school property), weapons, firecrackers, explosives, exterior antennas or satellite dishes, water beds, any open element cooking or heating appliance (e.g. hotplate), most electric cooking utensils (frying pan, woks, griddles, etc.) large refrigerators, barbeque grills (charcoal or gas).

        

                       Items-Permitted

               Computers, refrigerator (3.5 cu. ft.), small microwave ovens, hair dryers, heating pads, stereos, TV, VCR/DVD player, etc.

                    

Room Changes & Consolidations
                    
               All room changes must be coordinated through the Residential Life Coordinator. Room changes are done the first two weeks of the Fall semester. Room changes are completed by appointments only during the designated times. Room change requests after the second week of classes will be serviced on a case by case basis. Any roommate conflict should be taken directly to the Resident Assistant. If no solution is agreed upon the conflict will be referred to the Assistant Director of Residential Life.
               
               If you are not assigned a roommate or your roommate changes rooms, you will have 3 options. You can pay for a super single room, find someone to move in with you, or move in with someone else. Should you choose the “moving room” option, the Residential Life Office will provide you with a list of students who are in a similar situation. If you choose not to pay for the super single room, and do not find someone to move in with you, you may be required to move.
        


Student Status
                  
               Students residing on campus must be considered a regular, full time student.  As described in the New Mexico Tech catalog, full-time regular undergraduate students are those who enroll for 12 or more credit hours during the fall and spring semesters. (this designation does not apply to graduating seniors.)  Full time regular graduate students are enrolled for 9-12 credit hours per fall or spring semesters.  If any student is anticipating to drop below full-time status, they must obtain written permission from the Residential Life Office to allow for an exception to this requirement.  If written permission is not granted, students dropping below the minimum requirements risk termination of their housing contact which would require them to vacate their room or apartment.

Family Housing Specific Standards
                    

                       Children-Supervision
                       University provides no supervisory personnel for children on Family Housing property. The Resident is responsible for the supervision and safety of his/her children at all times. If children do become disruptive or continually bother other residents, action may be take by the Residential Life Office.


                       Furnishings
               All Units are equipped with an electric stove, refrigerator, sink, cabinets, and mini blinds for all windows. All items should remain in same condition as when the Resident initially moved in. Any damages due to the negligence of the Resident will be charged except ordinary wear and tear. Under no circumstances are appliances to be removed from the premises.
                    

                       Items-Not Permitted

                       Occupancy
                       Units shall be occupied only by the Resident and members of the immediate family (not to exceed five people in the 2-bedroom apartments) of the Resident and as a strictly private dwelling and for no other purpose prohibited by the Laws of the United States. The Resident shall not commit, permit any objectionable or disorderly, noise or nuisance whatsoever on the premises which disturb or interfere with the rights, comforts or conveniences of other residents.


                       Porches
                       Personal items are not allowed to be stored or left on the front porch/walkway. This presents a fire and safety hazard. Items may be kept on the back porches (i.e. bikes, lawn furniture, etc.) although, you are asked to keep this area organized and free of hazards. If a Residential Life staff member feels it is unsafe, then you will be asked to clean up the area.


                       Room Changes & Consolidations

                       Security Deposit
                       Resident shall deposit two hundred dollars ($200.00) to be held by the University pending the complete performance of the Agreement by Resident and to be refunded to the Resident less cleaning, damage or other assessments, if any, upon termination of this Agreement. Any cleaning or damage charges to the Resident in excess of the deposit shall be billed to the Resident.


                       Student Status
                       The lessee must actually reside on the premises and be enrolled in a degree program by the University at all times, with no less than six credit hours for graduate students and no less than nine credit hours for undergraduate students, except during summer sessions. All persons residing in family housing must be principal residents or children, spouses or wards of principal residents. If the situation changes, the principal resident has a responsibility to make arrangements with the Director of Residential Life, concerning continued occupancy.


                       Subletting
                       Units rented under this Agreement may not be sublet, doing so could result in eviction from the apartment.


                       Termination of Agreement

            By the University when rental account is not consistently maintained on a current basis. Rent is due at the beginning of each semester
            By the University upon one (1) week notice in writing for failure of the Resident to maintain adequate student standing in the University and if the Resident voluntarily withdraws from school.
            By the University upon thirty (30) days written notice to the Resident.
            By the University upon seven (7) days notice in writing to the Resident if suspended for disciplinary reasons by the Dean of Students.
            The $200 damage deposit will be refunded only if the Unit is left in as good condition as when rented, ordinary wear and tear excepted.


                       Utilities
                   Utilities (electricity and gas) are included up to $111.00 per billing period.  Any amount above this limit will be charged back to the Resident.



 VIOLATION OF RESIDENTIAL LIFE COMMUNITY STANDARDS
          
        One or more of the following sanctions will be issued by the Residential Life Office for violations of the Residential Life community standards.  Current and past infractions will be taken into consideration when determining the appropriate sanction.  In all disciplinary cases, the primary concern is to hold people responsible for their actions and to protect the welfare of the tenants living in the college community.  Sanctions are designed to underscore the necessity for a change of behavior.   Sanctions may include:


                Letter of Conduct Warning
        This letter is a formal written statement that a Resident or Resident’s guest’s actions are not acceptable and subsequent infractions will result in more severe action.


                Educational Session
        Attending an educational session may be imposed in lieu of, or addition to, other sanctions given (e.g. alcohol/ drug education class).
        Assignment of a task which is educational in nature and appropriate to the violation (e.g. letter of apology for offensive behavior). Failure to complete the assigned task will result in the initiation of further disciplinary action or community/public service project.


                Community/Public Service Project  
        Residents may be required to initiate and complete a supervised project on campus or in the community. Assignment of terms and number of hours will be assigned by the Residential Life Office.            


                Penalty Fee/Fines
        Payment of a penalty fee for services or violations of a specific policy will be billed directly to the students account.             


                Restitution
                This is a direct payment for theft or damage to property. The restitution should not exceed the cost of replacing or restoring the property and/or labor costs of replacement.


                Exclusion
        Residential Life serves the right to exclude those persons whose behavior is determined to be detrimental to the well being of the apartment/residence hall community or incompatible with its function as part of an educational institution. If a student is excluded from campus housing, they may not enter or be in the immediate vicinity of the residence halls/apartments.  If they are caught violating this exclusion, campus police will be contacted and further disciplinary action may follow such as fines or trespassing charges being filed.
        Students who do not reside in campus housing are also subject to exclusion if their behavior disrupts the educational mission of the residence halls.
                      

                Dismissal/Eviction
                  Residents dismissed for policy violations have 24 hours after notification to properly check out. Evicted residents forfeit their deposit and my be subject to additional penalties for damages and cleaning. Evicted residents do not receive any refund of housing cost regardless of when the eviction took place. In the event a student has been evicted, they may continue to participate in the meal plan program, unless circumstances warrant dismissal from the meal plan. It is the responsibility of the student to cancel the meal plan if the student chooses to do so. If the student’s behaviors or action constitutes dismissal from the meal plan program, the student may also be dismissed from the halls.

        
                Disenrollment/Expulsion
            Expulsion terminates a resident’s academic program and his/her right to future enrollment. Only the Dean of Students may expel a student. A student who has been expelled may not attend college functions, or visit the campus. Refunds for tuition and/or room and board will not be issued.


APPEAL, GRIEVANCE, AND COMPLAINT RESOLUTION
      The Residential Life appeal, grievance, and complaint resolution procedure is available to any resident for resolution of any disagreement or concern arising from the Residential Life policies or procedures.

      The resident must initiate the appeal, grievance, or complaint by discussing the problem or disagreement with the Residential Life Office within ten (10) working days of the event upon which the appeal and/or grievance is based.

      If the student and the Residential Life Office are unable to resolve the appeal or grievance to the satisfaction of the student, the student may discuss the appeal or grievance with the Director of Auxiliary Services within five (5) working days of meeting with the Residential Life Office. The employee, Residential Life, and Auxiliary Services should make every effort to reach an appropriate resolution.
      Within five (5) working days of the meeting with the Director of Auxiliary Services, the student may submit the unresolved grievance in writing to the Vice President of Student and University Relations. The written appeal or grievance must include a description of the event(s) giving rise to the grievance and a statement of the resolution requested.

      The Vice President of Student and University Relations will investigate the details of the grievance and will submit a written response to the student within ten (10) working days of receiving the written grievance.
